Terms and conditions for open seminars

The German version of this page is legally binding.

1 Defence clause and conclusion of contract

1.1 The following terms and conditions apply to all public standard seminars of Matthias Bohlen. Special conditions apply to individually designed events (such as VIP retreats).

1.2 The contractual conditions for participation in and the holding of seminars are governed exclusively by Matthias Bohlen's terms and conditions for public seminars. This also applies if the customer for their part works on the basis of their own general terms and conditions. In this case, where the terms and conditions of both parties agree, the matching terms apply; where they diverge, the statutory provisions apply in place of the deviating rules. Where only one party has made a rule on a subject in its terms and conditions, that rule becomes part of the contract.

1.3 Registrations must be made in writing or in text form. You will promptly receive a confirmation of registration in text form (ยง 126a BGB) or in writing. Without a written confirmation of registration there is no right to participate. The confirmation email we send immediately after receiving your registration only informs you that you have registered with us for a particular seminar and does not constitute acceptance of your offer. Before accepting, I first have to check whether a sufficient number of places is still available.

1.4 Registrations are considered in the order in which they are received; the possible number of participants for each event is limited.

2 Cancellations

2.1 Up to 21 days before the start of the seminar, cancellation is possible for a handling fee of EUR 50.00. If an early-bird discount or other discounts of 15 percent or more have been used, cancellation is possible free of charge up to 90 days beforehand. After that, a substitute participant must be named or the full fee must be paid. If a registered participant does not attend the seminar or attends only part of it, the full fee must also be paid.

3 Date guarantee

3.1 If a date guarantee is noted on the confirmation of registration, you have planning certainty immediately. Excluded from the date guarantee is a cancellation of the seminar due to circumstances for which I am not responsible, in particular force majeure (including proven illness of the trainer, failure of the heating, strikes, natural disasters, etc.).

4 Minimum number of participants

4.1 If, for events without a date guarantee, there are not enough binding registrations up to 14 days before the start of the seminar (the minimum number of participants is usually 7), the seminar may be cancelled.

4.2 The seminar may be cancelled at short notice for organisational reasons or due to illness of the lecturer. Any participation fees already paid will be refunded to you. There are no further claims.

5 Participation fees

5.1 Unless stated otherwise, seminar costs for public seminars (i.e. seminars that anyone can book) always apply per participant.

5.2 Payment terms: The participation fees are due 21 days before the start of the seminar. This is related to the obligations I have to enter into for the seminar (e.g. with the hotel as the venue). If payment has not been received by the first day of the seminar or no corresponding proof can be presented, I reserve the right to decide on further participation. This decision is made on the basis of a credit check. In the event of a negative credit decision, participation may be refused. The payment obligation remains unchanged regardless. Alternatively, the participant may pay the fee directly on site. In the credit check, I take into account previous sales, other open items, the size and age of the registering company and, where applicable, further information.

6 Scope of services

6.1 The scope of services results from the description of the seminar. Travel and accommodation costs are generally not included in the participation fees. However, I offer to reserve the corresponding accommodation for you at the seminar hotel.

7 Discounts

7.1 Early-bird discount: If you make a binding booking early enough (no option to withdraw; the early-bird period is stated for each training), you receive a 20% discount.

7.2 Colleague discount: When you have registered for one of my seminars, you receive discount codes with which colleagues and acquaintances can register for the same seminar at a reduced price. Please pass the discount codes on accordingly; then you yourself will benefit as well.

8 Copyright

I reserve all rights, including those of translation, reprinting and reproduction of the training materials or parts thereof, insofar as they are protected by copyright. No part of the training materials may be used for commercial purposes without the written permission of Matthias Bohlen, in particular not reproduced, distributed or made available to others via public networks.

9 Liability

I am liable for damages for which I am responsible, once, up to the amount of the typical risk of damage associated with the performance of the contract at the time it was concluded. Any further liability is excluded. Excluded from this limitation of liability are all damages to life, body and/or health and/or breaches of guarantees, as well as damages caused intentionally or fraudulently. Claims under the Product Liability Act (Produkthaftungsgesetz) also remain unaffected.

10 Data protection

The customer agrees that Matthias Bohlen collects, processes and uses the necessary data on the basis of the statutory provisions. In doing so, Matthias Bohlen may pass on the transmitted registration data or parts of it to involved third parties (e.g. external trainers) for the purpose of providing the service. For the processing of the contract, Matthias Bohlen may collect, process and use the personal data required for this (master data). The customer has the right at any time to receive information about the scope and content of the personal data stored about them. Likewise, Matthias Bohlen may process, use and delete necessary personal data that the customer creates in the course of the training. This includes performance assessments such as tests or assignments. Such data is stored and processed strictly anonymised and is never passed on to third parties. The sole purpose of processing this data is to improve the quality of the training.

11 Miscellaneous

Matthias Bohlen is entitled to list the participant's company in his customer list. Should a provision of this contract or of the respective supplementary agreement be or become invalid, the validity of the rest of this contract and of the supplementary agreements is not affected. With regard to all legal relationships arising from this contractual relationship, the parties agree on the application of the law of the Federal Republic of Germany. If the client is a merchant within the meaning of the German Commercial Code (Handelsgesetzbuch), a legal entity under public law or a special fund under public law, Bonn is agreed as the exclusive place of jurisdiction for all disputes arising in the course of the performance of this contractual relationship.
